Napa Home & Garden Inc is facing two lawsuits in South Carolina ? one relating to a personal injury claim in the Court of Common Pleas for the Ninth Circuit and the other a product liability claim in the United States District Court for the District of South Carolina. The personal injury claim has been filed by two Charleston-area residents who were injured when a firepot suddenly exploded and shot a directional flame. One of them suffered second and third degree burns to her lower body while the other was seriously injured as he tried to extinguish the flames. The incident occurred on May 21, 2011 when the two were enjoying an evening on their back porch.

The product liability lawsuit is filed by a Florida couple who were visiting relatives in Spartanburg, South Carolina. The incident occurred on May 25, 2011. The couple were enjoying an evening on the back patio when a ?torch-like? flame engulfed the wife resulting in second and third degree burns over 30% of her body. The husband suffered serious burns after attempting to extinguish the fire.

Both lawsuits claim that the plaintiffs suffered serious injuries due to negligent design, manufacturing and testing, as well as failure to warn on the part. The fuel used in the firepot is comprised of more than 90 percent ethyl alcohol, a volatile and highly flammable liquid with a vapor density less than that of propane.

Technically, products liability is not a relational tort, because the duties it imposes are not limited to persons who were in a contractual or other preexisting relationship with the manufacturer. Rather, it entitles anyone who is injured as a result of a product defect to compensation from the manufacturer.
